Legal Protection against Women Which Do Criminal Actions of Abortion from Victims of Rape for Justice

This study aims to identify and describe the legal protection of women perpetrators crime abortion, victims rape based on positive law in Indonesia order realize justice. uses a normative juridical approach, which is descriptive analysis. The data used secondary obtained through library research, then analyzed qualitatively. results this are for achieve justice that Article 48 Criminal Code perpetrator's actions committed due coercion, they will not be convicted. perpetrator was released from punishment grounds forgiveness, whereas Republic Act No. 36 2009, abortion allowed indications medical emergency threatens life mother pregnancy rape, given trauma caused by must experienced who very severe.
